InfraSensing One (1) Year Worldwide Limited Hardware Warranty

1. WARRANTOR AND SCOPE

This warranty is given by InfraSensing Distribution BV, Zaventem, Belgium, VAT BE0778959488 ("InfraSensing"). It applies to hardware products sold directly by InfraSensing to business customers ("Customer").

Products purchased through an InfraSensing OEM or channel partner are covered by that partner's own warranty toward its customer. In that case InfraSensing's warranty runs to the partner only.

Where a written agreement signed by InfraSensing contains different warranty terms, that agreement prevails over this policy.

2. WARRANTY COVERAGE

InfraSensing warrants its hardware products against Defects for a period of ONE (1) YEAR from the date of the InfraSensing invoice ("Warranty Period").

"Defect" means a failure caused by defective materials or workmanship that prevents the product from powering up, communicating or operating in accordance with its published functional specification. Measurement Performance as defined in section 3 is never a Defect.

If a Defect is confirmed, InfraSensing will at its sole option:

(a) repair the product at no charge, using new or refurbished parts;

(b) replace the product with a product that is new, or manufactured from new or serviceable used parts, and at least functionally equivalent to the original product; or

(c) refund the purchase price paid for the product.

A repaired or replacement product or part is warranted for the remainder of the original Warranty Period or ninety (90) days from the date of repair or replacement, whichever is longer. Any replaced product or part becomes the property of InfraSensing. When a refund is given, the product becomes the property of InfraSensing.

3. SENSOR MEASUREMENT PERFORMANCE IS EXCLUDED

Gas sensors drift and age by nature. The measurement performance of any sensor or sensing element ("Measurement Performance") is excluded from this warranty. None of the following is a Defect, whether it occurs at delivery or later:

(a) zero drift, span drift or baseline drift;

(b) accuracy, precision, resolution, repeatability, linearity, response time or detection threshold, including any deviation from a value stated in a datasheet, calibration certificate or test report;

(c) loss of sensitivity, ageing or end of life of the sensing element;

(d) cross sensitivity or interference from other gases, vapours, humidity, temperature, pressure or airflow;

(e) poisoning, inhibition, saturation or contamination of the sensing element, including by silicones, sulphur compounds, halogenated compounds, solvents, corrosive gases, dust, condensation or exposure to high gas concentrations;

(f) false alarms, missed alarms, or readings that differ from a reference instrument.

Calibration certificates and factory test reports reflect performance at the time of shipment only. The Customer is responsible for functional testing, bump testing, calibration and sensor replacement at the intervals set out in the product documentation and in the standards and codes applicable to the installation.

The product is one layer of a safety system. InfraSensing does not warrant that the product will detect every gas release, off gas event, thermal runaway or fire, or that it will provide any specific warning time. System design, installation, alarm setpoints and the response to an alarm are the responsibility of the Customer.

4. OTHER EXCLUSIONS

This warranty applies only to hardware products manufactured by or for InfraSensing and identified by the InfraSensing trademark, trade name or logo. It does not apply to hardware of other manufacturers or to any software, even when packaged, installed or sold with InfraSensing hardware. Other manufacturers, suppliers or publishers may provide their own warranties. Software distributed under the InfraSensing brand is governed by the InfraSensing End User License Agreement.

The following products are excluded from this warranty: cables, power adapters, batteries, mounting accessories and consumables.

This warranty does not cover damage or failure caused by:

(a) accident, abuse, misuse, misapplication or negligence;

(b) installation, storage, use or operation that does not follow the product documentation, or that exceeds the published electrical, environmental or gas exposure limits;

(c) problems with electrical power, including surges, lightning, incorrect supply voltage and electrostatic discharge;

(d) fire, heat, explosion, water, fire suppression agents, or venting gases, including those produced by the event the product is installed to monitor;

(e) service, repair, upgrade or expansion performed by anyone other than InfraSensing or a contractor authorised by InfraSensing;

(f) modification without the written permission of InfraSensing;

(g) removal, alteration or defacement of any InfraSensing serial number or label;

(h) installation of any software or firmware not supplied by InfraSensing;

(i) failure to perform preventive maintenance, functional testing or calibration;

(j) use of accessories, parts or components not supplied by InfraSensing;

(k) normal wear and cosmetic damage;

(l) transport of a product returned to InfraSensing;

(m) any cause other than a hardware failure.

InfraSensing and its authorised partners are not liable for damage to or loss of any programs, data or other information stored on any media, or for any product or part not covered by this warranty. Recovery and reinstallation of system software, application software and user data are not covered.

5. TERRITORY

WARRANTY SERVICE IS ONLY PROVIDED FOR PRODUCTS LOCATED IN THE COUNTRY OF THE DELIVERY ADDRESS STATED ON THE INFRASENSING INVOICE.

6. OBTAINING WARRANTY SERVICE

To obtain warranty service, request a Return Material Authorization ("RMA") number here. The request must be made within the Warranty Period and within thirty (30) days of discovering the Defect, and must include the serial number, the InfraSensing invoice number and a description of the failure.

InfraSensing may require troubleshooting with its support team before issuing an RMA number. No product may be returned without an RMA number. Returns without an RMA number will be sent back at the expense of the sender.

Returns must follow the RMA instructions:

(a) the RMA number must be clearly displayed on the outside of the package;

(b) shipping costs, duties and taxes must be prepaid by the sender. Shipments with charges due on receipt will be refused and returned at the expense of the sender;

(c) the customs declaration must state the value and description given in the RMA instructions and identify the shipment as a product returned for repair;

(d) use a carrier with reliable tracking. InfraSensing is not responsible for lost or misdirected returns.

The address of the InfraSensing Repair Center and the return shipping terms are specified in the RMA.

If no Defect is found, or the failure is excluded under this policy, InfraSensing will invoice its work at USD 110 per started hour, plus parts and return shipping.

INFRASENSING IS NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING LOST PROFITS, DOWNTIME, LOSS OF GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, THIRD PARTY CLAIMS AGAINST THE CUSTOMER, PRODUCTS NOT BEING AVAILABLE FOR USE, LOSS OF DATA OR SOFTWARE, THE COST OF RECOVERING, REPROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH INFRASENSING PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT.

INFRASENSING'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

INFRASENSING DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR OR EXCHANGE ANY PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA.
